1. Introduction

These Terms of Service ("Terms") govern your use of software and services provided by itamisoftware ("Company", "we"). By using our software, you agree to these Terms. If you do not agree, do not use the software.

2. Eligibility

You must be at least 18 years old or have legal capacity to enter contracts in Poland. By using our services, you confirm you meet these requirements.

Subject to these Terms and payment of any applicable fees, we grant a limited, non-exclusive, non-transferable license to use the software. You do not gain ownership rights in the software.

If you are a consumer under Polish law, you may withdraw from a digital product purchase within 14 days unless you have started using or downloaded the software with clear acknowledgment of losing the right to withdraw.

You are responsible for account credentials and all activity on your account. Notify us immediately of unauthorized access.

7. Payments and Refunds

All payments are non-refundable unless otherwise stated or required by law. We may suspend or terminate access for unpaid fees.

8. Risks and Ban Disclaimer

The software is provided "AS IS". We do not guarantee prevention of account restrictions or bans. You are solely responsible for consequences of using the software. For B2C users, this disclaimer is limited by mandatory consumer protections under Polish law.

9. Limitation of Liability

The Company is not liable for indirect, incidental, or consequential damages. Aggregate liability is limited to amounts paid by the user in the last 12 months.

10. Indemnification

You agree to indemnify the Company against claims or damages arising from misuse or breach of Terms.

11. Termination

We may suspend or terminate access for violations or suspected misuse. License ends upon termination.

12. Governing Law

These Terms are governed by the laws of Poland, including the Civil Code (Kodeks cywilny). Disputes go to the competent courts in our registered city.
